GENERAL CONDITIONS

               1. General Conditions

               1.1. We, De Freight Intermodal B.V., act as a forwarding agent only, unless explicitly agreed otherwise in writing. All our activities are subject to our General Conditions. In addition, the Dutch Forwarding Conditions, latest edition, including the arbitration clause, as filed by FENEX at the Registry of the District Courts of Rotterdam and Amsterdam, are applicable and to all orders which exclusively concern the warehousing of goods the Dutch Warehousing Conditions, latest edition, including the arbitration clause, as filed by FENEX at the Registry of the District Court of Rotterdam, are applicable. All conditions mentioned will be supplied upon first request and free of charge and can be downloaded from www.fenex.nl


              1.2. Our rate quotations are based on current exchange rates, charges and employment conditions and are not including V.A.T., if applicable.

              1.3. Rounding off for weights or m3: Up to 1000 kg to 10 kg up, above 1000 kg to 100 kg up, m3 to next 10th of a m3 up.

              1.4. Conversion factors, if applicable: European Distribution: 1 m3 = 330 kg minimum, 1 loading meter = 1750 kg minimum, 1 euro pallet (80 x 120 cm), if not stackable and if nothing can / may be loaded on top: 700 kg minimum, 1 block pallet (100x120 cm), if not stackable and if nothing can / may be loaded on top: 875 kg minimum. There are other ratios applicable for Ocean and Air Freight: Ocean Freight: 1 m3 = 1000 kg / Air Freight: 1 m3 = minimum 167 kg. Packages with a length of more than 3 meter may cause a length surcharge.

              1.5. Goods have to be adequately packed to avoid internal damage during transportation.

              1.6. The address of loading and / or discharge must be accessible for an international truck (13.6 m trailer). For consignments of more than 1000 kg, a tilting lift surcharge may be applicable.


               2. Payment conditions:

               2.1. Payment of our invoice within 2 weeks, unless agreed otherwise in writing. Due to the fact that we have to pay duties and V.A.T. in advance, we uphold the right for a shorter payment term. This will be indicated on the invoice.

               2.2. Reclamations can only be accepted for consideration if made within 8 days of the date of our invoice.

               2.3. Advance provision: 2% on duties, V.A.T. and ocean & air freight unless agreed otherwise in writing.

               2.4. Cash on delivery: Cash on delivery consignments can only be delivered against payment of cash and / or bank guaranteed cheques and / or presentation of an irrevocable banker’s proof of payment.

               2.5. Cash on delivery commission: 1 % of the invoice sum, with a minimum of € 12,00 per consignment and a maximum of € 50,00 per consignment. This does not include any costs resulting from refusal of the delivery.

               

               3. Other conditions:

               3.1. Hazardous materials: The shipper / consignor / supplier of hazardous materials is always responsible for correct labeling, packing, transport documents, consignor declaration, MSDS and the hazard classification card; these provisions must always be in the prescribed languages. The transport costs are generally subject to a hazard surcharge, depending on the chosen route / destination.

              3.2. Insurance: Our rates are always quoted excluding transport insurance. We will only arrange transport insurance on request of your instruction in writing. We will charge administration fee besides the insurance premium. Insurance policy costs as per outlay.

              3.3. Special wishes / requirements: Any special instructions regarding aspects such as delivery date / time and / or customs clearance must be communicated in writing. A surcharge can be applicable. 

              3.4. Making out custom documents / clearance: The principal / customer remains responsible for the clearance / discharge of customs documents, respectively for the proper information of the contents or the products and the applicable tariff-code / H.S. code, at all times, notwithstanding the sales conditions. As soon as non-discharge / non-clearance notification by the competent authorities is received, respectively that the contents or the product is not corresponding with the tariff-code / H.S. code, we are forced to take action. A lump sum administration fee of € 75,00 per case is then applied chargeable to principal / customer. This is excluding any duties, fines and our man-hours.

              3.5. Europallet (EUR) exchanges: If euro pallets have to be exchanged, you must provide us with a written instruction. Contact must always be made with a member of our staff regarding this. A surcharge may arise if applicable.

              3.6. Customs-scan / physical check: we will charge you all costs concerning a customs-scan / physical check.

              3.7. Waiting hours / waiting time at container terminal: Waiting hours for FTL / FCL: 2 hours free for loading, 2 hours free for unloading. Groupage: pro-rata. Waiting time at container terminal 1 hour free. After that it will be € 50.00 per hour or part thereof.

              3.8. Failed freight: For cancelled shipments 75% of the freight costs can be charged.

              3.9. Gas control: Gas control of containers will be performed according to the Dutch rules & regulations of the “Arbo”-inspection (Dutch Safety & Health Act) and for the account & risk of the principal.
